NEW! MONEY-MAKING IDEA FOR NOTARIES

Janet Dillenbeck sent me an excellent idea for making extra money as a notary signing agent. She suggested charging a $50 fee to provide training to notaries in her area that need a mentor. I assume this $50 would also include Janet going on an actual signing with the notary in order to provide them with on-the-job experience.

Any notary who has made the choice to go into the business full-time will know that $50 is a very reasonable fee to pay for several hours of training. Most instructors charge $100 or more per hour with a 4 hour minimum; so for only $50 the new notary signing agent is getting a great bargain, especially when they will make the money back on their first signing.

If you are experienced in loan signings you could do the same for notaries in your area. Just fax your name, city, state, phone number and email address to 614-801-1962 and I will begin listing mentors in future issues of The Notary News. Other notaries will contact you and you can charge $50 for training and make some extra money helping others just like Janet suggested.

I think this will help to promote the “notaries working together” concept that 50 State Notary has always encouraged. Thank you Janet for your excellent suggestion.

Dear Victoria: In your notary book you make reference to a pharmacy where you save a lot of money on your prescriptions. What is the name of the company?

Here is Ohio when I purchase the same medication I spend about $260. But I can get the same medication from the pharmacy above and the cost is only $88.

Dear Victoria: Please don’t reveal my name. Is there anyplace you know of where I can get a computer now and pay for it without a credit check? My credit has some blemishes and I cannot get credit through Dell Computer?

Dear Subscriber: I saw an advertisement recently from My Computer Club at http://www.mypccredit.com that sells computers with no money down. But I have not investigated the company, so be sure to check them out before spending any money. Also be sure to read the fine print. Some of these companies that grant credit without a credit check charge higher interest fees. You may end up spending $3,000 for a computer that only has a value of $700. I am not saying this is always the case but watch out for this possibility.

I subscribe to an excellent magazine called “Law Office Computing.” This is one of those very few magazines I cannot wait to arrive in the mail and I read it from cover-to-cover. Anyway – in the February 2004 issue there was an article about a freelance service that provides dictation services to attorneys nationwide. I immediately checked out this website at http://www.lawdocsxpress.com/ and I was very impressed to say the least. These people really have got it together.

Although they are not processing bankruptcy petitions, this company provides you with evidence that working for attorneys nationwide is one of the fastest growing ways for notaries and paralegals to utilize their skills. While notarizing documents for mortgage companies is an excellent business, if you only provide one type of service your income will fluctuate from month to month. The only way to even out the monthly income flow for your business is to branch out and offer more services. Just make sure those additional services are relevant to your notary business. Working freelance for attorney’s nationwide drafting bankruptcy petitions is just one of the many ways to accomplish this. EXAMPLE OF BAD MARKETING (Learn From This)

Graphico Publishing (a subsidiary of 50 State Notary) received an email solicitation from a small business owner this past week. We immediately recognized the bad marketing mistakes and decided to use it as a training tool to help you.

The email solicitation said:

I am a designer currently working freelance. My skills and experience include digital and conventional photography B+W/Color, the development of 2-d and 3-d graphic pre/post production computer modeling, children’s book design, Interactive multi-media, illustration, website layout, and game design. I am currently looking for work in book, magazine and album cover design as well. If you have need of such work please contact me at (contact information withheld).

When you read this do you immediately notice the problem? If not, then you will learn a good lesson from this article. The problem with the email solicitation above is that it does not tell me what benefit this person is to my company. Instead, this person spends 85% of the email telling me about who they are and their experience.

This is one example of how the email should have been written and I would have responded to it:

I visited your website and was very impressed with the services your company offers. I noticed that Graphico Publishing provides book cover design services for your customers. I have excellent skills and experience in the area of book cover design and would love to send you some samples of my work for consideration. Thank you for your time.

Do you see the difference between the two? You must find out what your potential customers need and target that need specifically. Also, a little flattery doesn’t hurt. Do not make the mistake of telling a potential client everything about your wonderful experience, then sit back and “hope” they will figure out how which one of your skills are beneficial to them.

Secondly, the original email solicitation ended with the sentence “If you have need…” This is another very bad mistake. The word “if” does not build faith in your company and its services. The person should have said: “I am sure you will be pleased with my design services, fast turnaround and 100% guarantee.” A sentence like this would have demonstrated a faith in this company’s products and the benefit to me as the customer. But telling me “if I have a need” immediately tells me this person is not very aggressive and provides no benefits to its customers.

Therefore, as you communicate with businesses, write emails, cover letters and brochures – it is important to focus on the customer ONLY. The only time you need to brag on yourself is to support the services you can provide to meet the customer’s needs.

I answer many telephone calls and emails from notaries who are desperately seeking other notaries in their area to be their mentor and assist with training. SOUTH CAROLINA NOTARIES NEEDED

I had a company send the following email requesting South Carolina notaries contact her for assignments. She is a small company and needs very experienced and reliable notary signing agents. As you will see in the email below, the last notary she hired had no concern for the job.

I admire your Notary News and all the literature you publish. I have been very successful with the signing process. I make sure everything is done correctly and I have stopped using a notary that does not take this process seriously I thought this would be good for both of us but in the end he wanted to go out on his own and has held documents for 11 days. He also started expecting me to print e-docs and giving him the full fee.

DOCUMENT HANDLING IN A HOMESTEAD STATE

Dear Victoria:

A nationwide signing company that recently contacted me about an assignment asked if I was aware of the correct signing procedure for a husband and wife as my state was a "homestead state". As a result of their question, I consulted with my husband who is an experienced real estate agent. He answered my question, and also showed me the answer in a book in his library of real estate references. The book is "Real Estate Principles", Eighth Edition, by Charles J. Jacobus and Bruce Harwood. As it turned out, my state is actually a "dower" state, not a homestead state. An explanation of the difference between the two terms is shown below.

I thought it might be worthwhile sharing the question, answer, and reference with other notaries who subscribe to your site. While the answer will explain the difference in the terms that will affect correct signing procedures for a husband and wife, each notary should investigate the answer to this question based on their own state laws:

According to the reference, "Statutory estates are created by state law. They include "dower" which gives a wife rights in her husband's real property; "curtesy" which gives a husband rights in his wife's real property, and "community property". Additionally, there is "homestead protection" which is designed to protect the family's home from certain debts and, upon the death of one spouse, provides the other with a home for life.

Historically, dower rights came from old English common law in which the marriage ceremony was viewed as merging the wife's legal existence into that of her husband's. From this viewpoint, property bought during marriage belongs to the husband, with both husband and wife sharing the use of it. As a counterbalance, the dower right recognizes the wife's efforts in marriage and grants her legal ownership to one-third (in some states one-half) of the family's real property for the rest of her life. This prevents the husband from conveying ownership of the family's real estate without the wife's permission, and protects her even if she is left out of her husband's will.

Dower:
In real estate sales, the effect of dower laws is such that when a husband and wife sell their property, the wife must relinquish her dower rights. This is usually accomplished by the wife signing the deed with her husband or by signing a separate quitclaim deed. If she does not relinquish her dower rights, the buyer (or even a future buyer) may find that, upon the husband's death, the wife may return to legally claim an undivided ownership in the property. This is important if you buy real estate, and is the main reason a property's ownership is researched by an abstracter and the title insured by a title insurance company.

Curtesy:
Roughly the opposite of dower, curtesy gives the husband benefits in his deceased wife's property as long as he lives. However, unlike dower, the wife can defeat those rights in her will. Furthermore, state law may require the couple to have had a child in order for the husband to qualify for curtesy.

Community Property:
Nine states (Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington, and Wisconsin) subscribe to the legal theory that each spouse has an equal interest in all property acquired by their joint efforts during the marriage. This jointly produced property is called "Community Property". Upon the death of one spouse, one-half of the community property passes to the heirs. The other one-half is retained by the surviving spouse. When community property is sold or mortgaged, both spouses must sign the document. Community property rights arise upon marriage (either formal or common law) and terminate upon divorce or death.

Homestead Protection:
Nearly all states have passed homestead protection laws, usually with two purposes in mind (1) to provide some legal protection for the homestead claimants from debts and judgments against them that might result in the forced sales and loss of the home, and (2) to provide a home for a widow, and sometimes a widower, for life. Homestead laws also restrict one spouse from acting without the other when conveying the homestead or using it as collateral for a loan. Although dower, curtesy, and community property rights are automatic in those states that have them, the homestead right may require that a written declaration be recorded in the public records....".

Because dower and curtesy rights originally were unequal, some states interpret dower and curtesy so as to give equal rights, while other states have enacted additional legislation to protect spousal rights....the basic purpose of dower and curtesy (and community property laws) is to require both spouses to sign any deed or mortgage or other document affecting title to their lands, and to provide legal protection for the property rights of a surviving spouse.

QUESTIONS AND ANSWERS FOR BANKRUPTCY FORMS PROCESSORS

Dear Victoria: I bought your book, How to Start a Bankruptcy Forms Processing Service and also joined the Annie Mae network. I also paid $299 to buy the software program from Annie Mae. I have to access the software online. But I am told by Gary Drury at Annie Mae that I don’t need your book for training. Is this so?

Dear Subscriber: I have received many emails that are similar to yours over the past few weeks and declined to publish a public response until now. In the past, instead of mailing a public announcement, I called or emailed the subscribers explaining that 50 State Notary is a totally separate company from Annie Mae. Mr. Drury was a subscriber to The Notary News just like everyone else. He sent us a Press Release for publishing and asked me to talk about my book at three teleconferences he hosted back in August 2004. Also, Mr. Drury gave 50 State Notary a free trial membership to Annie Mae but that membership expired last year.

But I have now received a ton of telephone calls and emails regarding questions and comments about Annie Mae. However, I am unable to comment as I have not seen the software, visited their website or taken part in any decision-making process.

But I do know that any software program used within the legal system must be approved by the court system so that the forms comply with their regulations. Because bankruptcy is FEDERAL law, the federal government has stringent laws that must be met for the filing of court documents.

Just like tax return software. If you buy a software program like Turbo Tax to do your taxes for 2004 – there will be an update you will have to install next year because of the changes and updates in the tax code. Bankruptcy software works in the same fashion. So if the software program you buy is not approved by the court and the developer has not subscribed to a program to receive automatic updates from the federal bankruptcy courts – the petition you prepare could be rejected when it is filed.

To play it safe, when I had The Lawyer Assistant, I used the software that all the bankruptcy attorneys used. That software program was Best Case. You can download the trial version or purchase the Single-User License for Chapter 7 for $595.95 by going online to http://www.bestcase.com/products.htm What I love about Best Case is that once you pay the $595.95 – you never pay that price again. They send you 10-20 updates per year free of charge and the renewal is about $169. Also, I know that Best Case is approved by the federal government and the software has won many awards for its ease of operation.

Finally, to address the issue whether you need training or not to draft bankruptcy petitions, think about this: Even the IRS provides instructions for filling out tax forms. How could anyone think they could prepare court documents without some form of training? Perhaps you misunderstood Gary Drury. He may have thought you were asking if you needed any “paralegal” training. The answer to that question is “NO.” Sure – it helps to have any type of training but the information in my book, How to Start a Bankruptcy Forms Processing Service is NOT taught in any paralegal school. Therefore, it doesn’t matter if you are a paralegal or not – if you have not drafted bankruptcy petitions before, you still need information about how to do the job.

To get that information you either need to do one or more of the following:

1. Spend $250 - $300 to attend a bankruptcy paralegal seminar, like the ones offered at http://www.nbi-sems.com/.
2. Spend $1,000 or more to attend an online bankruptcy paralegal school, like the one offered at http://www.legalstudies.com/bankruptcy.html
3. Pay $150 for the training CD: http://www.lawyerassistant.com/cds/
4. Buy the training book for $59.99 at http://www.bankruptcybook.net

Remember – when you prepare bankruptcy petitions you are holding the life of a REAL person in your hand. If you do a poor job, you could cause the attorney and the person (who is in a desperate situation) a great deal of harm. I urge everyone NOT to enter the bankruptcy forms processing field unless you truly care about helping others who are in desperate financial conditions. If you are only in this for the money, you might as well stop now and go into another line of business.

Dear Victoria: Thank you for referring me to Andy Matyac concerning the bankruptcy business. It all sounds very exciting and the thought of making $25,000 or even more per month makes my head spin. But what I need to know is how I can run the business and not have any contact with attorneys?

Dear Subscriber: Let me start by asking you a few questions: How many customers do you think a grocery store would get if they didn’t talk to people? How would you feel if you walked into the corner market to buy a gallon of milk and everyone looked down at the ground and refused to talk to you? Would you go back to that store?

Of course you are NOT going to run a business working for attorneys if you do not talk to them. My second concern is “why” you are afraid to talk to your customers (who happen to be attorneys)? Do you think they are going to attack you or hit you in the nose? What reason, please tell me, would anyone be afraid to talk to an attorney? An attorney is just like a doctor, teacher, beautician, secretary or steel worker. They are all people who work for a living and have jobs.

But if you are really that scared to talk to your own customers, who pay you good money for doing a job for them – I strongly urge you to seek another profession or go back to working for someone else. This trait is one that must be conquered or your business is destine for failure. I wish you the best of success in conquering your fear based solely upon fantasy thinking.

MARKETING TIP FOR NOTARY SIGNING AGENTS

A few days ago I picked up the telephone and a notary on the other end said: “I would like to make an application.” I said, “For what?” She replied: “For work.”

First I was totally stunned. I could not imagine that anyone on the planet would attempt to market this way. But our conversation continued like this:

Victoria: 50 State Notary does not employ notaries, however we have a job bank on our website at www.50statenotary.com.

Notary: But I want to sign up and work for you.

Victoria: 50 State Notary does not employ notaries. We train notary signing agents.

Notary: So you won’t give me a job here in Florida?

Victoria: (I gave up at this point, provided her with our website address and quickly got off the phone.)

What should this notary have done to market herself correctly? Two things:

1. She should have taken the time to visit our website (she initially had to find us on the internet anyway) and determine the type of company we were before picking up the telephone to call us.

2. If we would have been a signing company she would have said something like:

Hello. My name is Suzie Goldstein. I am a notary public commissioned in the state of Florida and am interested in working as a notary signing agent for your company. Could you tell me how to apply or find out more information?

A notary called me this past week and he made an interesting statement about marketing: “You can tell five people what to say and 3 of those 5 will never make a dime, but 2 of the 5 will have more customers than they can handle. The difference is the twist they add when marketing their business. 2 of the people will say exactly the same thing the other 3 are saying, except they say it with a slightly different twist.”

He is correct! Marketing is an ongoing process. You try a method and if that method doesn’t work, you try something else. If that doesn’t work, you try something else. You continue trying new things until finally something works. There are no cookie-cutter methods – just suggestions and tips which I try to include in every issue of The Notary News to help you look at things differently so you can market your business better.

WRITING SALES MATERIALS FOR YOUR TARGET MARKET

Let’s pretend for a moment that you want to hire a housekeeper to come in once a week and clean your house. You put an advertisement in the newspaper and you receive the following two responses. Which person would you contact for an interview?

APPLICANT NO. 1: Sends you a fax that states: “I love to sew and knit and I make all my own Christmas decorations. Please call me.”

APPLICANT NO, 2: Sends you a fax that states: “I have been a housewife for 27 years and am highly skilled in fast and efficient housecleaning. I would welcome the opportunity to talk with you.”

Of course you would choose Applicant No. 2. Applicant No. 1 doesn’t tell you anything to help you determine if they have any experience to clean your home or not. They only tell you about their personal talents which have no relevance to the job you are seeking to fill.

Although this example appears to be a simple lesson in common logic – when many people try to market their companies they make the same mistake as Applicant No. 1 did in our example above.

One of the KEYS to writing sales materials for your target market is to find out specifically what type of people are reading your information and what their needs are. Then you address those needs and show them how YOU are the best person for the job. This is called “selling yourself.” It is the same techniques used when applying for jobs and going on interviews. You match your background with the job requirements.

So before writing a sales letter, compose an email for marketing or submit a description of your business for notary directories, take a moment to find out WHO the audience is. One easy way to do this when listing your services in other notary directories is to view the directory and see what other people have written. In other words – make it a habit to always study your competition. But don’t study your competition in order to find loop-holes where you can “screw them to the wall” and put them out of business. (This is bad business.) Instead, look for ideas in your competition that produce success for them. Then combine those ideas with ideas of your own and customize your own unique marketing plan.

Marketing can be a lot of fun! But step one is learning to take your eyes off your needs and focus on the people you want as your customers.

QUESTIONS TO VICTORIA RING

Dear Victoria: The things I do not enjoy about being a Notary Signing Agent are: Waiting for documents to download, and sending by fax signed docs at end of signing, and faxed HUDS that are sent after the original docs are received. Sometimes waiting for these documents have caused me to have to juggle my time between signings. This is very stressful as I like being in control of my time. I have lost jobs due to the lateness of downloading documents. I think companies should have the documents before they hire a notary.

Dear Subscriber: I totally AGREE with you. For some notaries, the things you mentioned on your list are enjoyable or tolerated without stress. In fact, many notaries look at your list as challenging and exciting.

But this doesn’t mean that you are weird. You, I and a host of other notaries have felt exactly the same way you do at one point in their career. I am sure that someone has written a book on this topic somewhere, but it all boils down to recognizing and identifying the things that you enjoy doing. Life is meant to enjoy – not to create stress. The first step to taking charge of your future is recognizing “who” you are and what you enjoy doing. Then you can take steps to form your business around your own personality.

In your particular case, you may want to begin seeking other areas of the real estate and legal field that would better fit your working preferences. Notarizing documents to close mortgage loans is only the “tip of the iceberg.” There are literally millions of other ways you can utilize your skills in this industry – you just would be doing a different job in another area. The real estate industry is wide open with possibilities. But you will need to spend time researching the different fields until you find one that fits you. I cannot tell you what “that” is. I can only offer ideas. But the real fun is discovering for yourself what exactly you enjoy doing and what direction you want your business to take.

I urge you to seek other avenues that better fit your lifestyle and working preference. If you are not enjoying what you are doing, your business will suffer and possibly be destroyed. You must LOVE your business in order for it to grow and prosper so you can become financially independent.

Dear Victoria: It has been two days now I have sent e-mails to two other people from their website, I might add, asking about some of their products and have yet to get a response. And then people wonder why their business goes down??

There are always two sides to every scenario. Besides, you cannot solely rely on the internet for communication. There is a possibility that your email was never received (due to internet glitches) or it was routed to the wrong person. Before you make a final decision about any company that does not respond to your email, follow-up with a telephone call. You may find they are an excellent company to deal with but they never received your email inquiry. So at this point in time, I would suggest you give them the benefit of the doubt before jumping to conclusions.

Dear Victoria: I am a bankruptcy attorney in Kansas. A couple of weeks ago I did a search on the internet for the word “bankruptcy” and your book How to Start a Bankruptcy Forms Processing Service came up on the internet search. At first I thought the book may have been a scam so I ordered a copy with the intention of reporting you to the government.

However, I was astonished when I received the book and read it. I even learned things about debtor bankruptcy that I didn’t even know. I checked out the facts and leads you provided and I could not find anything of any fraudulent nature. You did not tell me “what” you were asking these attorneys when you called them so it would be impossible for me to determine what the problem in your marketing is. However, real estate attorneys are definitely your target market. Perhaps you are calling and asking them something like: “Do you hire freelance notaries.” In this case, most attorneys would answer that question with a “no.”

But if you call and say something like: “I am a notary signing agent experienced in the closing of mortgage documents. Do you currently use a service to assist with the notarization of real estate transactions?” You may find the attorney does not perform the closing at all. That job may be one that the bank or mortgage company handles. In that case, you need to contact the bank or mortgage company for potential freelance work.

But in some cities and towns the attorney is responsible for closing the loan and obtaining the signatures of the borrowers on the documents. These are the types of attorneys you need to target market for your notary services. Since they are not permitted to have a financial interest in any documents that are notarized by them, they are not permitted to perform the notarization. These attorneys will normally hire freelance notaries to accompany them at the closing or will send the notary out after the documents are explained to the borrower and agreed to verbally.

IMPORTANT LESSON IN MARKETING

This past week I received about 25 email messages that all said something similar to this:

“I am unemployed at this time but would like to know if I can get a “deep” discount on your bankruptcy and notary book. If you don’t want to, I will understand.”

My first thought was: “Do people who write email messages like this go to the store and ask them to deeply discount a computer desk because they are unemployed and want to start a business?” I don’t think so. The average person will pay the price for the items they wish to purchase and if they don’t have the money they won’t buy them. But for some reason, a few people believe that by offering an “excuse” another person will feel sorry for them and give away free merchandise out of the goodness of their heart.

Wake up folks! This is NOT how you start out marketing a business and building a professional image for yourself in the industry! You should NEVER send out business communications that depict your company as poor and struggling. Back when I started my first business I had a budget of $10 per week for advertising. I would have loved to have had the money to buy an advertisement in Small Business Opportunities magazine, but their ad rates were $150. It never entered my mind to write a letter to Small Business Opportunities magazine and tell them I was a poor, struggling company and request they discount their advertising to give me a chance. That would be like “begging” and I took a great deal of pride in my business. I made sure that every company I communicated with thought of me as a solid company that was rapidly expanding. This is the key to doing business with other businesses.

Secondly, if someone cannot afford to purchase the information they need to start their business, how in the world do they expect to build a business? A business needs money to survive and prosper. Just like you cannot survive without money, your business cannot survive without money either. If you believe you can start a business with absolutely no money, you are mistaken. An up-front investment must be made in order to obtain the materials you need to start your business. If you cannot afford them – work and save up the money until you can. Don’t make your business look small and worthless by sending out communications claiming your business is poor and struggling. No serious business person will respond to that type of message.

Thirdly, the 25 or so people who emailed me their request to discount my products NEVER once offered me a price. They used words like “discount” and “price break”. I wish just one person would have said “I am offering you $40.00,” but not one of them quoted any specific price. They wanted to leave it up to me to do the work for them – which was another mistake when you are negotiating prices with companies.

Finally, to end the email with sentences like “If you don’t want to I will understand” is ridiculous. Of course I don’t want to. What would make these people think I woke up this morning looking for ways to give-away my products so the company does not make any money today? Not one of those people offered anything in return for the favor they were requesting. Even if someone would have said something like: “I am willing to send you a deposit now of $40 because I would really like to get my business started. If you will ship the books, I will pay the remaining $24.49 within 30 days after receipt of the merchandise.” Or better yet – the serious person would have waited until they had the money and ordered the product. Therefore, how could I possibly believe these people were serious and had the drive necessary to utilize the information in both the notary and bankruptcy book?

(Note: Portions of the bankruptcy book was sold at seminars where attendees paid $200 or more per day to attend. The average price for a book with the magnitude of information it contains is normally priced in the $350 range in the legal market. Pricing the bankruptcy book at only $59.99 is already a deeply discounted item.)

In summary – my motive here is not to hurt the feelings of the 25 people who emailed me this past week. My purpose is to help some of you WAKE UP out there. If I did not care about you, I would not have taken the time to write this article, so I hope it helps to educate you in the world of marketing your business.
